Boat wreck trial set for Calif. Coast Guard driver

"I could tell that they had no clue that we were even in the water," DeWeese told National Transportation Safety Board investigators, according to a transcript released last month.

DeWeese is expected to recount the tragedy again, this time at a court-martial for Petty Officer Paul Ramos, the driver of the Coast Guard vessel. Opening statements are expected Monday at Coast Guard district headquarters in Alameda.

Ramos pleaded not guilty to involuntary manslaughter, negligent homicide, aggravated assault, hazarding a vessel and dereliction of duty. DeWeese, who was hosting two other families, said the Coast Guard vessel came at him at an estimated 30 to 40 knots — or 35 to 46 mph — after a fireworks display.

One Coast Guard crew member estimated the Coast Guard boat was going 20 to 25 knots, according to an NTSB transcript.

DeWeese said he hit the throttle and turned right, but it was too late. After the boat struck, he found two of his sons safe. He came across 8-year-old Anthony face-down in a pile of life jackets, "not moving, not conscious, just in a weird position."

"We knew something bad," DeWeese told investigators.

The NTSB, which has released more than 4,000 pages of documents, has not said what caused the crash.

Mike Neil, an attorney for the DeWeese family, said the Coast Guard vessel is designed for high seas — not congested areas — because the bow rises when it picks up speed, blocking the driver's view.

"This boat should never have been used under these circumstances," said Neil, who represents the DeWeeses in a wrongful death lawsuit against the federal government. "There's going to be another accident."

Ramos, who refused to speak with NTSB investigators, said at a preliminary hearing last year that he thinks about the dead boy every night.

Ian Howell, the highest-ranking member of the patrol boat crew, faces a court-martial in May on charges of negligent homicide, assault, negligence with a boat and dereliction of duty. He pleaded not guilty.

There were three other crew members. Brittany Rasmussen was reprimanded but avoided time in the brig after pleading guilty to dereliction of duty in military court.

The Coast Guard dropped a charge of dereliction of duty against Lavelle Teague. Jarett Koelmel was never charged.

Gay legislators having impact in marriage debates

In Hawaii and Illinois, gay state representatives were lead sponsors of civil union bills signed into law earlier this year. In Maryland and Rhode Island, gay lawmakers are co-sponsoring pending bills that would legalize same-sex marriage. In New York, a gay senator, Tom Duane, is preparing to be lead sponsor of a marriage bill in his chamber later this session.

"For my colleagues, knowing that I am not allowed to marry the person that I love and want to marry, that's very powerful," said Duane, a Democrat from Manhattan. "It's more difficult for them to take for granted the right they have to marry when I don't have it."

The gay lawmakers have impact in two important ways. Their speeches, often evoking personal themes, can sometimes sway wavering colleagues, and they can forge collegial relationships even with ideological foes through day-to-day professional and social interaction.

Rep. Deborah Mell, a Chicago Democrat elected to the state House in 2008, made a point of bringing her partner to legislative functions, and a year ago announced their engagement on the House floor.

The fiance, Christin Baker, was on hand when Mell gave an emotional speech Nov. 30 during the civil union debate. One of Mell's points: Current law would bar doctors from consulting her if Baker, her partner for more than seven years, became seriously ill.

"The more visible we are, the better," Mell said in a telephone interview. "When you look someone in the eyes, it's a little harder for them to deny that we should have the same rights."

Also speaking in that debate was Greg Harris, another gay Chicago Democrat, who urged his colleagues to be "on the right side of history."

The vote was 61-52 to allow civil unions, the Senate followed suit a day later, and Gov. Pat Quinn signed the bill into law on Jan. 31.

Harris — who is HIV-positive — said last week he felt pressure delivering that floor speech.

"What you say or don't say can win or lose a critical vote," he said. "There was a palpable sense that one way or the other, history was going to be made and everyone on the floor was going to be remembered for that vote."

In Hawaii, where a civil unions bill was signed into law last month, one of the key players was House Majority Leader Blake Oshiro, a gay Democrat.

Oshiro stood up in the closing minutes of the 2010 session to force a House vote on the measure, which was approved but vetoed in July by Republican Gov. Linda Lingle. In September, Oshiro won a primary election over a former Honolulu councilman who strongly opposed civil unions, then beat a Republican in November — ensuring the bill would re-emerge this year with a supportive Democrat, Neil Abercrombie, taking over as governor.

For Oshiro, the key moment was deciding to make a personal plea to members of his Democratic caucus to overcome their doubts and agree to a vote on civil unions in April 2010.

"I was thinking I wouldn't be able to really look in the mirror, knowing I had just let it fade," he said. "Ultimately, the caucus supported bringing it to the floor, even if some of them didn't support the bill.

"That was my one 'ask,'" he said. "The governor vetoed it, but it really set the stage for this year."

Hawaii and Illinois are now among seven states that allow civil unions or their equivalent — state-level marriage rights in virtually everything but name. Five other states and Washington, D.C., let gay couples marry outright, and Maryland and Rhode Island would join that group if pending bills win approval.

The Maryland marriage bill cleared the Senate by a 25-21 vote on Feb. 24. The debate included a speech by the chamber's only openly gay member, Richard Madaleno, citing his partner of 10 years and their two children.

"He is my spouse in every sense of the word, but to the law, he remains a legal stranger," Madaleno said.

Timing is uncertain for a vote in the Maryland House, which has six openly gay members. But freshman lawmaker Mary Washington, a lesbian from Baltimore, has been anticipating the chance to speak in support of the bill.

"It will be an important moment in Maryland history," she said. "I wouldn't miss the opportunity to speak up, not just for myself but for the many families in Maryland who need protection."

In Rhode Island, legislation to legalize same-sex marriage has failed in previous years, but advocates are optimistic this year because the new governor, independent Lincoln Chafee, is supportive. One of the bill's co-sponsors is Democratic House Speaker Gordon Fox, who is gay; he has not yet set a timetable for voting on the bill.

"He's passionate about this issue," said Kathy Kushnir, executive director of Marriage Equality Rhode Island. "It's not an abstract issue to him — he's talking about his life, his family."

Among the bill's leading foes is the Rhode Island branch of the National Organization for Marriage, headed by Christopher Plante.

Plante described Fox as "very pragmatic" and said he clearly has the potential to influence some colleagues during the debate on the bill. However, Plante asserted that its chances of passage remain questionable, notably in the state Senate.

In 2009, New Hampshire's legislature became the first to legalize same-sex marriage without ever facing pressure from marriage-rights lawsuits.

One of the emotional high points of that debate was a speech by Rep. David Pierce, a gay Democrat from Hanover who is raising two daughters with his partner. He described telling his oldest child, 5 at the time, that "some people don't believe we should be a family."

Afterward, Pierce said, a fellow representative came over to say that the speech prompted him to change his vote in favor of same-sex marriage.

After last November's election, the Democrats became the minority in both chambers, and Republicans proceeded to introduce bills aimed at repealing same-sex marriage.

Pierce serves on an election law committee chaired by David Bates, prime sponsor of one of the repeal bills.

"We acknowledge we fundamentally disagree on that question," Pierce said. "But it doesn't have to dissolve into being uncivil. ... We treat each other with as much respect as anybody."

He said he had only one conversation with Bates on the marriage issue last year, recalling that the Republican had told Pierce not to take the repeal effort personally.

"I said, 'Of course it's personal. You want to delegitimize my relationship with my partner of 18 years, and my two kids,'" Pierce recalled.

Bates, whose repeal bill is now scheduled for consideration next year, said he and Pierce work together well in the Legislature despite "diametrically opposed opinions on marriage."

As for the impact of Pierce's 2009 speech, Bates said, "It played upon the sympathies of individuals who don't think the matter through."

According to the Gay and Lesbian Victory Fund, which recruits and supports gay political candidates, the number of openly gay and lesbian legislators nationwide has increased from 44 in 2003, when it started counting, to 85.

Chuck Wolfe, the fund's president, said gay legislators were having an impact even in relatively conservative states where gay marriage has no short-term prospect of winning approval. He cited the example of Arkansas Rep. Kathy Webb, whose heartfelt arguments played a role in the rejection of a bill to bar gays from adopting or foster-parenting.

Gay lawmakers "are people, as opposed to issues," Wolfe said. "The impact of having one of your colleagues directly affected by the legislation on the table is very powerful."

Summary Box: Parts shortage closes auto plants

THE PROBLEM: A fire on Wednesday at an auto parts plant northwest of Detroit has forced production cuts by two automakers and could spread to three others. So far General Motors Co. and Mazda Motor Corp. have closed plants, cut shifts or they have stopped making some models due to a parts shortage. The plant also makes parts for Ford Motor Co., Chrysler Group LLC and Nissan Motor Co., but so far they have not cut production.

THE REASON: Magna International Inc. had to close the fire-damaged plant near Howell, Mich., where interior parts are made. Changes that have made the auto industry more efficient mean there are few parts stockpiled at assembly plants. Many of the factories rely on the Howell factory for parts.

THE SOLUTION: Magna is looking at trying to reopen the damaged plant, moving its machinery to a nearby factory or finding a way to make the parts at other Magna factories.

Egypt's military appoints first post-Mubarak PM

The opposition hailed the decision as another victory for "people power" but many warned pressure must be maintained on the military to implement other democratic reforms, including an accountable police agency and a new constitution.

Leaders of the 18-day uprising that forced Mubarak to resign had been pressing the military to fire Ahmed Shafiq, arguing that a prime minister sworn in by the ousted leader should not stay in office. They also were angry that his Cabinet was filled with figures from the old regime.

The military's official Facebook page said former Transport Minister Essam Sharaf had been chosen as prime minister and asked to form a caretaker Cabinet during the transition to civilian rule.

Activists say they had recommended the choice of Sharaf.

"First we ousted Mubarak. Second, we got rid of Shafiq. We have become again the owners of this country," said Bassem Kamel, a member of the Youth Coalition, an umbrella group of activists who launched the protests Jan. 25.

Sharaf, who served in the Cabinet for 18 months between 2004 and the end of 2005, has endeared himself to the youth groups by visiting them in Cairo's central Tahrir, or Liberation, Square, the uprising's epicenter. An engineer, Sharaf also appeared to fit the image of a professional civil servant who after leaving office founded a group of like-minded scientists called "the age of science."

"He is a reformer and was a vocal critic" of the old system, said Shady Ghazali, another protest leader.

The youth celebrated in the way that was the pillar of their uprising: on social networking sites. Soon after his appointment, the name of the new minister started trending on Twitter.

"We are writing the electronic revolutionary history. Long live Egypt," wrote Abdel-Rahman Mohamed, a 20-year-old student.

The Youth Coalition also canceled a Friday sit-in in Tahrir Square calling for Shafiq's resignation. Instead, there will be a rally to celebrate their latest victory and they invited Sharaf to deliver his oath in the square.

Pro-democracy activist and Nobel laureate Mohamed ElBaradei thanked the military for "listening to the people."

"Today (the) old regime has finally fallen. We are on the right track," ElBaradei said on his Twitter account. He is a likely presidential candidate who has returned to Egypt since the protests after a long absence that upset many of his supporters.

"Let us all get down to work and start rebuilding our country. We want the world to know that Egypt is open for business," said ElBaradei, the former head of the U.N. nuclear watchdog agency.

U.S. State Department spokesman P.J. Crowley said the change represented "an ongoing process in Egypt," demonstrating that officials are "responding to the aspirations of their people."

The military's prompt acceptance of Shafiq's resignation shows the sensitivity of the generals to the demands of the uprising's leaders and concern that long protests could complicate returning life to normal.

Since Mubarak's ouster, Egypt has experienced a crime wave not seen in years, with a marked rise in armed robberies, arson and battles between rival criminal gangs over territory. Demoralized and hated by many for their perceived brutality against protesters, security forces have yet to fully take back the streets. They numbered around 500,000 on the eve of the protests.

Many believe the military should focus on restoring law and order in the country of 80 million people.

Since it took charge of managing Egypt's affairs on Feb. 11, the Supreme Council of the Armed Forces promised to hand power over to a new government and elected president within six months. It disbanded both houses of parliament and promised to repeal the emergency laws, though only when conditions permit.

The council also appointed a committee to amend the now-suspended constitution to allow for elections.

But many are concerned the military rulers are moving too slowly.

"They do respond to pressure but they make sure it is on their own pace," said activist and blogger Alaa Abdel-Fattah. "We want decentralized democracy. They will resist. They want it highly centralized to keep control."

The military has yet to tackle the more complicated issues of dissolving the former ruling party and local councils, and restructuring security agencies— seen as the main tool for propping up Mubarak's regime.

There has been no release of political prisoners or prosecution of security officials behind the deaths of protesters — key opposition demands.

On Thursday, two leading Muslim Brotherhood figures were released on medical grounds after serving almost two-thirds of a seven-year sentence.

One of the two, Khayrat el-Shater, the brotherhood's chief strategist, said he expects the charges of money laundering and terrorism against him to be dropped because they violated international legal standards.

"We understand these trials were imposed on the military before by the tyrant Mubarak. But now we won't find them any more excuses. They should drop all these sentences," he told The Associated Press after his release.

The military, however, continued to be criticized for its human rights record. The New-York based Human Rights Watch said the new rulers use military tribunals to prosecute dozens of civilians, all charged with criminal offenses, including weapons possession and curfew violations.

"Egyptian military authorities are continuing one of the worst practices of the Hosni Mubarak government by prosecuting civilians in military tribunals," said Sarah Leah Whitson, Middle East and North Africa director at Human Rights Watch.

Malta refusing to return Libyan fighter jets

The Maltese government refused to let a plane land in Malta last Wednesday because the passengers included two Libyan pilots who had been sent to fly the Mirage jets back to Libya, said Martin Bugelli, head of information for the prime minister's office.

He said the Maltese government was now abiding by a U.N. arms embargo imposed on Moammar Gadhafi and his family on Sunday.

The two Mirages landed at Malta's airport on Feb. 21 and their pilots asked for political asylum amid Gadhafi's bloody crackdown on anti-government protesters.

Initially, the Libyan government asked for the jets back, and on Wednesday sent a plane carrying two pilots to fly them home, Bugelli said.

The Maltese government had previously acknowledged that it had refused to let that plane land, amid reports that Gadhafi's daughter was on board. On Tuesday, Bugelli said the reason was because the passengers included the two pilots.
